Interstate Adoption

Agencies and attorneys who practice outside the state of Illinois must follow Illinois procedures to comply with Illinois statute (750 ILCS50/4.1(b)) that governs the Interstate Placement of Children who were born outside the state of Illinois and the adoptive family resides in Illinois. Agencies and attorneys may reference the attached Illinois ICPC procedure, checklist and ICPC regulation 12 for more information that outlines requirements for ICPC private/independent adoptions.

An out of state agency can request a home study for purposes of placing a youth in the state of Illinois. Regulation 2 ensures the youth’s safety and well-being is monitored throughout their placement.
